NHS Pension Scheme age discrimination – are you affected?

When the 2015 NHS pension scheme was introduced, older members (those within ten years of retiring) were allowed to continue with their final salary schemes in the 1995 or 2008 sections.

This has been confirmed to be discriminatory against younger members of the scheme by the Court of Appeal and the government intends to redress the situation across all public sector pension schemes.

Those affected will need to choose which set of backdated scheme benefits they would prefer to receive for the ‘remedy period’ which is between 1 April 2015 to 31 March 2022. They may choose between the former final salary scheme or the new average salary scheme.

A new consultation has been launched to decide when members should make this choice – immediately after the remedy period in 2022 or at retirement.

The 2015 Pension Scheme consultation will close on 11 October 2020.
