Did you opt out of the NHS Pension Scheme between April 2015 and March 2022? As part of the ‘McCloud remedy’ you might be able to ‘buy back’ the pension service you missed during this time.
If you opted out of the pension scheme when the 2015 Scheme was introduced, you may have made a ‘contingent’ decision. This is when you base your decision on the information available at the time, but may have chosen differently if you could have predicted being put back into the 1995/2008 Section for the remedy period.
So if you chose to opt out because you believed the new 2015 scheme was less beneficial than your legacy pension scheme, you could now have the right to amend your decision.
You may have also opted out temporarily, cancelled Added Years or Additional Pension arrangements. The McCloud remedy allows you to buy back the applicable missing service.
The NHS Pensions Agency should send a letter to confirm if you are entitled to change your decision.
We will continue to keep you updated as new information is released.
